Terms and Conditions
In
the following Terms and Conditions, "Dabcom
Solutions" means and includes all agents, employees,
partners, the proprietor, owner and representatives
of Dabcom Solutions.
All fees
paid to Dabcom Solutions are non-refundable unless
otherwise stated.
Dabcom reserves the right to change prices at any
time, unless other terms have been agreed upon.
Any
account not brought current within a week (7 days)
from notification, or exceeding any other agreed
time frame in any way is subject to suspension.
Cancellation
Dabcom Solutions reserves the right to cancel
services at any time.
Lawful Purpose
Dabcom Solutions reserves the right to refuse
services to anyone. Customers may only use Dabcom
Solutions services for lawful purposes. Transmission
of any material in violation of any law or local
regulation is prohibited. This includes, but is not
limited to; copyrighted material, material legally
judged to be threatening or obscene, and material
protected by trade secrets. Dabcom Solutions
expressly forbids anyone from using Dabcom Solutions
servers (or servers in the use of Dabcom Solutions)
for the propagation, distribution, housing,
processing, storing, or other handling in any way
material which is illegal or that which we deem to
be objectionable, including, but not limited to; warez, pornography, or web sites promoting bigotry,
hate, discrimination, or like subjects. The
designation of any materials as such described is
entirely left to the discretion of Dabcom Solutions.
Bandwidth
Dabcom Solutions does not provide a guaranteed
bandwidth and reserves the right to cancel any
hosting or other services should bandwidth usage exceed
that which Dabcom Solutions deems to be reasonable.
Indemnification
By using our services you agree that you will
defend, indemnify, save and hold Dabcom Solutions
harmless and free from any and all demands, liabilities,
losses, actions, costs and claims, including legal costs and
fees asserted against Dabcom Solutions, its agents,
its customers, officers, owners, proprietor and
employees, that may arise or result from any service
provided or performed or agreed to be performed or
any product provided or sold by Dabcom Solutions.
You agree to defend, indemnify and hold harmless and
free of any liability Dabcom Solutions against liabilities arising out of
(1) any injury to person or properties caused by any
products or services sold or otherwise distributed
in connection with Dabcom Solutions' services or
property; (2) any material supplied by customers
infringing or allegedly infringing on the
proprietary rights of a third party; (3) copyright
infringement; (4) defective products sold to
customers from Dabcom Solutions' servers or (5) loss
of business as a result of any service provided by
Dabcom Solutions.
Disclaimer
Dabcom Solutions will not by responsible for any
damages your business may suffer. Dabcom Solutions
makes no warranties of any kind, expressed or
implied for services we provide. Dabcom Solutions
disclaims any warranty or merchantability or fitness
for a particular purpose. This includes loss of data
resulting from delays, non-deliveries, wrong
delivery, and any and all service interruptions
caused by Dabcom Solutions and its employees . Dabcom
Solutions reserves the right to revise its policies
at any time.
Failure to follow any term or condition will be
grounds for immediate account deactivation. |
